A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특수협박 피고인은 2015. 8. 30. 03:30경 과거 피해자 C(44세)와 도박하면서 돈을 많이 잃은 것에 앙심을 품고 대구 북구 D에 있는 E 모텔 옆 골목길로 피해자를 불러낸 다음 왼손으로 피해자의 뒷덜미를 잡아당기며 미리 소지하고 있던 ‘칼갈이’(전체 길이 43cm, 날 길이 30cm)를 오른손에 쥔 상태로 피해자의 왼쪽 목에 가져다 대고, “장난친 것을 인정해라, 인정 안하면 손가락을 자르던지, 배때기 국물 좀 흐를끼다.”고 말하였다.

Accordingly, the defendant threatened the victim by using a knife, which is a dangerous object.

2. Special robbery Defendant and F: (a) the victim C (the age of 44) was stuffed with the Defendant in the past and conspired to take money by threatening the victim with a deadly weapon; and (b) the victim C (the age of 44) was imprisoned,

Therefore, the victim has a frighten victim.
