A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

On December 5, 2013, the Defendant was sentenced to a four-month term of imprisonment for fraud at the Daegu District Court, and was sentenced to a six-month term of imprisonment for fraud at the Daegu District Court on August 28, 2014, and the said judgment became final and conclusive on September 5, 2014, and the execution of the said sentence was terminated on July 25, 2015.

1. On November 3, 2015, the Defendant: (a) around Daegu Dong-gu, Daegu-gu; (b) around 21:00, and (c) around 5, “D main points” operated by the Victim C, as if he would pay the drinking value and the helper cost; (b) ordered alcohol and the share; and (c) issued an order with the helper.

However, there was no intention or ability to pay the drinking value and the helper cost because there was no special property or cash possessed by the defendant without any income.

As above, the Defendant: (a) by deceiving the victim; (b) provided the victim with 5 Cerriju and 1 Berriju in the same place; (c) did not pay KRW 100,000,000 in total of the drinking value and the Doriju for about one hour; and (d) did not pay for the amount of money equivalent to the same amount of monetary benefits.

2. On November 19, 2015, the Defendant: (a) around 19:00, around 5, “G main points” operated by the Daegu Northern-gu E and the Victim F, as if he would pay the alcohol value and the helper cost; (b) ordered the alcohol and the share; and (c) issued an order with the helper.

However, there was no intention or ability to pay the drinking value and the helper cost because there was no special property or cash possessed by the defendant without any income.

The Defendant: (a) by deceiving the victim as above; (b) provided the victim with beer 15 C, 2 C, 2 C, and 1 C, 1 C, 1 C, 1 C, and C, 240,000 won in total, and 240,000 won in the amount of playing and playing for two hours; and (c) thereby, acquired property benefits equivalent to that amount.
