A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 도로교통법위반(음주측정거부) 피고인은 2013. 11. 2. 23:40경 서산시 운산면 서정아파트 앞 도로에서 술에 취한 상태로 B 아반떼 승용차량을 운전하던 중 위 승용차를 도로상에 정차시킨 채 잠이 들어 신고를 받고 출동한 서산경찰서 C파출소 소속 순경 D가 피고인을 깨운 후 피고인의 발음이 어눌하고 말을 더듬으며 걸음이 비틀거리는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어, 같은 날 00:38경 서산시 읍내동 서산경찰서 운산치안센터에서 약 30분에 걸쳐 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구하였으나 피고인은 음주측정기에 입김을 불어넣는 시늉만 하고 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.
