The prosecution of this case is dismissed.

1. On April 1, 2018, the Defendant: (a) on April 1, 2018, on the part of Seo-gu, Incheon, Seo-gu, Seo-gu, Incheon, carried out horse fighting with the victim C (Woo, 54 years old) who was seated in the steering line while driving Bone Starex vehicle from the perfect distance; and (b) loan issues.

The Defendant assaulted the victim by taking the back of the victim's back as his hand on the ground that the victim was in a fight during the horse match and then milling the victim.

2. Determination

(a) Applicable legal provisions: Article 260(1) of the Criminal Act;

(b) Crimes of non-violation of intention: Article 260 (3) and (1) of the Criminal Act;

C. The expression of intention not to punish: On July 30, 2018, after the institution of the instant indictment, a written agreement that contains the victim’s expression of intention not to punish the victim was made.

(d) Judgment dismissing a public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
