Defendant
A shall be punished by a fine for negligence of KRW 1,500,000, and by a fine of KRW 4,000,000.
The Defendants respectively.
Reasons
Punishment of the crime
C and Defendant B accepted and jointly operated Co., Ltd. E in Eunpyeong-gu Seoul Metropolitan Government from F on May 201. After issuing checks and bills in the name of Eunpyeong-gu, Defendant B agreed to take over and register them as the representative director of the said company with the knowledge that they will issue checks and bills in the name of E, E, C, and Defendant B, and Defendant A agreed to receive KRW 2,00,000 per month.
C and the Defendants, on October 14, 2010, acquired E, a stock company which entered into a check contract with the non-identical branch of Korea bank under the name of E, and around that time, changed the name of the representative director of the said check contract to A and traded the check number. On September 3, 2010, E, a stock company, which entered into a check contract with the non-identical branch of Korea C, under the name of E, took over from the time of acquisition to May 201, after changing the name of the representative director of the said check contract to A.
1. On May 201, the Defendants and C conspired with the check number G, and issued a check number “G”, the face value and the date of issuance in blank, and one copy of the check number per unit number per the above bank in the name of Defendant A, a representative director of the company, in which Defendant A is the representative director.
On July 20, 201, the check was issued on July 19, 201 by the legitimate authority, and the face value of 9.8 million won, and the check was presented to the above bank on July 20, 201, which was within the period for the presentation of payment, but the check was not paid as the suspension of transaction.
2. The check number H, I and C in collusion with the above date, time, place, and right to supplement the face value are limited to three million won, and the check number “H”, par value and date of issuance are blank, and Defendant E is the representative director.
