Reasons
Punishment of the crime
[2015 order 293] Around June 8, 2012, the Defendant stated that “E” operated by the victim D in Ulsan-gu, Ulsan-gu, U.S.A., “E” that “I will take domestic auction goods at the price and bring profits from the market price by selling them,” and that “I will give KRW 50 million if I lend KRW 30,000,000 to 30,000,000 won as money is insufficient.”
However, the Defendant is a real operator of F Co., Ltd. established for the purpose of real estate development projects. However, the Defendant was the actual operator of F Co., Ltd., who was established for the purpose of real estate development projects. However, around October 2012, the Defendant’s land outside G G and four parcels of land where the construction of the factory site is proceeding with F Co., Ltd., Ltd., and the appraisal of which exceeds 1.67 billion won as of the end of October 201, and there was no property value, and thus, it was not possible to obtain additional loans for the above factory site as security. At the time, the Defendant was liable for the total amount of KRW 1.29 billion to victims in relation to the case on which he was sentenced to imprisonment for fraud at the Ulsan District Court on September 23, 2011, but it was impossible to properly carry out construction works without any specific property. Therefore, even if the Defendant borrowed money from the victim, there was no intent or ability to repay the principal and interest to the victim within a short period of time.
Nevertheless, the Defendant: (a) by deceiving the victim as above; (b) transferred KRW 27 million from the victim around June 18, 2012; (c) transferred KRW 30 million from June 21, 2012; and (d) acquired KRW 30 million by deceiving the victim.
[2015 Highest 837] The Defendant, at the office of the Defendant located in Ulsan-gu, Ulsan-gu, U.S. H around December 2012, the victim I is working for the construction of the factory site in G in light of 'Gyeongju-si', and if an appraisal report is made, the loan can be made immediately at the bank.
