1. The Defendant shall pay to the Plaintiff KRW 37,234,00 and the interest rate of KRW 12% per annum from September 12, 2019 to the day of complete payment.

In addition to the overall purport of the pleadings, evidence Nos. 1 and 2 (including additional numbers), the Plaintiff is recognized as having received a contract from the Defendant for D and completed each construction work upon being awarded a contract for E, etc., the Plaintiff’s attempted payment of KRW 220,000 for D construction cost, KRW 47,014,00 for E construction cost, and KRW 10,000 for the Defendant’s repayment to the Plaintiff on September 11, 2019.

Therefore, the Defendant is obligated to pay to the Plaintiff the amount of KRW 37,234,00 (=220,000 won - KRW 10,000 - 10,000) and damages for delay calculated by the rate of 12% per annum under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from September 11, 2019 to the date of delivery of the original copy of the instant payment order.

Therefore, the plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
