A defendant shall be punished by imprisonment for one year.

Punishment of the crime

[2018 Highest 3268] No person shall engage in speculative activities as a business using slot machines or speculative gaming machines, except the speculative businesses permitted by the Act on Special Cases concerning Regulation and Punishment of Speculative Acts, Etc.

1. On April 20, 2012, around April 17, 2012, the Defendant: (a) established 80 game machine of “sea-to-sea” in the “C” operated by the Defendant on the 2nd floor of Daejeon Seo-gu Daejeon, Daejeon; (b) employed a business director in name and an employee D (an issuance of a summary order on December 25, 2012) from that time employed; (c) provided, from that time, multiple unspecified customers who find such places with 10,000 won in the said game machine and who started to put 10,000 won in the game machine; and (d) provided, at the beginning of the game machine, exchange the remainder after deducting 10% of the points obtained, in cash.

As a result, the Defendant was engaged in the speculative acts, other than the speculative acts permitted under the Act on Special Cases Concerning the Settlement of Speculative Acts, which cause financial gains or losses to the users by using the speculative gaming machines.

2. Around June 4, 2012, the Defendant: (a) set up a 70 game machine for the “marine camping out” in “C” as indicated in paragraph (1) of the same Article; and (b) provided an unspecified number of customers, who employed the head of the business affairs in the name of the Defendant and his/her employees, with the same method as described in paragraph (1).

As a result, the Defendant was engaged in the speculative acts, other than the speculative acts permitted under the Act on Special Cases Concerning the Settlement of Speculative Acts, which cause financial gains or losses to the users by using the speculative gaming machines.

[2018 Highest 3757] The Defendant is a person engaged in driving a gallon car.

On December 14, 2015, at around 14:00, the Defendant, without a driver’s license for a motor vehicle on December 14, 2015, is one-lane of the five-lane distance in front of the Mansung-dong, Daejeon, Seosung-gu.
