The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for six years.
Sexual assault, 40 hours against the defendant.
Reasons
1. The Defendant, as the biological father of the victim B (here, C) in 2005, was raising the victim while divorced with his wife in around 2005, and was willing to commit an indecent act against the victim and sexual intercourse by force by using the fact that the victim does not easily refuse his request, the sole guardian.
In violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (livering between Minors, etc.) (13 years of age) the Defendant committed similar rape by force of: (a) on June 2013 to July 18, 200, the Defendant continued to put the victim’s sexual organ into the victim’s chest and line with the victim’s clothes located at the victim’s home located at the age of 9 or 10 years of age at the time; (b) continuously put the victim’s chest and line into the victim’s chest and line; and (c) repeated the victim’s finger, 2,3 times of finger, and 18:0 years of age from the Defendant’s home located at the victim’s home located at 13 years of age, and 11 years of age at the time; (d) put the victim’s sexual organ into the victim’s body; and (e) put the victim’s finger into the victim’s body by force; and (e) put the victim’s finger into the victim’s body.
B. Around 22:00-23:00 around the early 2014, the Defendant, at around 22:0 to 23:00, 1 of the Act on the Protection of Children and Juveniles against Sexual Abuse (hereinafter “Violation of the Child and Juveniles against Sexual Abuse”) : (a) went home from the cares of the Defendant’s house victims (the age of 13 at that time) and her f, who was f and f, was fright back to the bed by the victim’s her hand; and (b) even though the victim was her hand and refused, the Defendant she was raped with the victim by force by putting her fingers into the part of the victim’s drinking, b2:0-23:0, around the early 2016, and 14:00, around the first 23:00, and 14:0, at that time, she went home from the Defendant’s house care of the Defendant (the age of 14).
