A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. Around February 1998, the injured party exported to Uzbekistan the 6 vehicles of Soaa 3 and 6 vehicles of Soaa Naa 1 from April of the same year, and the 76,500,000 won per 5 vehicles out of the above vehicles from June to 8, 1998, were delivered to the injured party several times, and the remaining 27,30,000 won per 27,000 won per 2 vehicles for the injured party, while the injured party kept the 6 vehicles of Soa 3,000 won per 10,000 won per 27,000 won per son for personal use at around that time.
2. Around May 15, 1998, the Defendant: (a) the Hyundai Automobile D Office located in Mapo-gu Seoul Metropolitan Government (“Seoul Mapo-gu”) told the victim E to “if the machinery to manufacture lock has been exported to Uzbekistan, profit occurs; (b) if the machinery was leased KRW 20,700,000,000, the machinery was purchased and sold, and then the principal and profit would be paid.”
However, even if the defendant receives money from the victim, he did not have the intent or ability to purchase the locking machinery and export it to Uzbekistan, and sell it to the victim and deliver the proceeds to the victim.
The Defendant, by deceiving the victim and deceiving the victim, received gold KRW 20,700,000 from the victim around that time, and acquired it by fraud.
