A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On June 2015, the Defendant was the victim C(Y, 47 years of age) and the previous relationship, who was notified by the victim C of this objection, was aware of the relationship between the victim D(62 years of age) and C, the owner of the pention building, and the victim C.

피고인은 2015. 7. 7. 17:40 경 피해자 C가 운영하는 경북 영덕군 E에 있는 ‘F 의원’ 앞에서, 피해자 D이 에 쿠스 승용차를 운전하여 피해자 C을 위 차량 조수석에 태우고 나가는 장면을 목격하고 피고인의 엑 티 언 스포츠 화물차를 운전하여 경북 영덕군 병곡면 영리에 있는 고래 불 교차로 까지 에 쿠스 차량을 미행하였고, 같은 날 18:20 경 고래 불 교차로에 이르러 에 쿠스 차량이 갓길로 차로를 변경하여 내리막길로 서 행하자 피해자 C이 피고인을 배신하고 다른 남자와 함께 있다는 사실에 격분하여 위험한 물건인 피고인 운전의 엑 티 언 스포츠 차량의 가속 페달을 계속 밟아 에 쿠스 차량의 뒷부분을 들이받아 그 충격으로 에쿠스 차량이 도로 밖으로 약 10미터 가량 튕겨 나가 약 4 미터 아래에 있는 논둑 위에 우전도 되게 하여 피해자 D에게 진단 12 주의 L( 요추 )4 부 위의 골절, L( 요추) 2 부 위의 골절, 안와 바닥의 골절, 우측 늑골 (3 ~8 번) 골절상을, 피해자 C에게 진단 14 주의 방출성( 요추 1번) 골절, 횡 돌기( 요추 2~5 번) 골절상을 각 가 함과 동시에 에 쿠스 차량이 튕겨 나가며 그곳에 설치되어 있는 시가 10,600,000원의 교통 신호 제어기 1대와 G 펜 션 소유 시가 550,000원 상당의 입간판 1개를 부수어 이를 손괴하였다.
