Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

Some revisions were made to the extent that it does not interfere with the defendant's defense right.

No credit card merchant shall lend the name of a chain store to any third party.

On May 14, 2014, the Defendant lent to C the name of the credit card merchant of D Co., Ltd., which it operated, and thereafter, C paid off the sales of KRW 6,244, totaling KRW 399,381,635, supra, until October 6, 2014.

Accordingly, the defendant lent the name of credit card member store to another person.

Summary of Evidence

1. The defendant asserts that, although he/she consented to the additional installation of a credit card terminal as necessary for the franchise business, he/she did not lend the name of a credit card merchant to C by allowing C to use the credit card terminal.

However, it was confirmed as follows based on the evidence duly adopted and investigated by this Court that H, who installed a card device to C, additionally installed the card device to the Defendant at the time, was sent the additional device to the Defendant.

(2) The defendant stated that it is necessary to transfer to C the head of the Tong and the OTP card if he merely gives consent to the opening of a credit card terminal by making the test.

It is not visible that the defendant received a return after the lapse of a week, and the actual settlement is conducted, and the payment is made to the head of the Tong. However, in the case of a credit card, if the payment is made after a month, the payment is made after the first month, and if it is scheduled to return it, the payment will be withdrawn.
