1. The defendant shall be the plaintiff.
(a) Category 1, 2, 3, 4 and 1 of the Annex A, among the first floor of the building listed in paragraph 1 of the Annex A.
Reasons
1. Indication of claim;
A. On May 12, 2016, the Plaintiff agreed on May 12, 2016, among the first floor of the building listed in paragraph (1) of the attached Table No. 1, the part on the ship (a) connected each point in sequence 1, 2, 3, 4, 100,000 won in a lease deposit, 4 million won in a month of rent (excluding value-added tax, 25 prepaid payment in a month), and 4 million won in a lease deposit from May 25, 2016 to May 24, 2018, and received four million won in a lease deposit, and the remainder 3,6 million won in a lease deposit.
B. On May 25, 2016, the Plaintiff, among the lands listed in paragraph (2) of the attached Table list, leased part (B) of the attached Table 2 to the Defendant by setting the lease deposit of 3 million won, monthly rent of 300,000 won (in addition to value-added tax, monthly payment of 25 days), from May 25, 2016 to May 24, 2018.
C. On June 3, 2016, the Defendant agreed to pay to the Plaintiff the amount of KRW 39 million payable (i.e., KRW 43 million - KRW 43 million - KRW 4 million paid on May 12, 2016) out of the total lease deposit on the real estate stated in the foregoing paragraphs (a) and (b) (i.e., KRW 43 million) until July 31, 2016; however, the Defendant agreed to pay the Plaintiff a delay interest of KRW 6% per annum from June 1, 2016 to the date the payment of the said amount payable is completed.
The defendant paid on July 29, 2016, KRW 20 million among the above-paid lease deposit of KRW 39 million, and KRW 16 million on August 22, 2016, respectively, and has not paid up to the present day the remainder of KRW 3 million (=39 million - KRW 20 million - KRW 16 million).
E. As of November 30, 2016, the Defendant’s delay damages for the rent and electricity charges, water supply and sewerage charges, and unpaid lease deposit amount are KRW 25,889,262 in total (i.e., the rent of KRW 1,578,000,000 for electricity charges of KRW 9,421,605 for delay damages of KRW 185,138 for delay damages of KRW 502,519 for waterworks and sewerage charges of KRW 185,138 for delay damages)
1) Unpaid rent = 15.780,000 won = 8.660,00 won in total (=4.330,000 won) for rent for June 2016 and July 2016.
