A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
[2017 Highest 731] On February 17, 2017, the Defendant: (a) on February 17, 2017, around 09:30, the Defendant: (b) taken a cab operated by the victim B before the mountain patrol box located in the Sinsan-si, Busan-si, and (c) took the cab at the C taxi operated by the victim B; and (d) took the evalescent hospital located in Gwangju-gu, Gwangju-gu
However, the defendant did not have the intent or ability to pay taxi costs.
The Defendant: (a) by deceiving the victim as above; (b) had the victim operate a taxi; and (c) did not pay an amount equivalent to KRW 41,360 of the taxi fare; and (d) obtained pecuniary benefits equivalent to the same amount from the victim from that time until February 20, 2017; and (c) received property equivalent to KRW 79,500 from the victims on four occasions from that time, such as the list of crimes in attached Table, and acquired pecuniary benefits equivalent to KRW 41,360.
[2017 Highest 1504] On April 10, 2017, the Defendant 1,300 smallest 1,300 won of the market price owned by the victim G located in H Mart operated by the victim G located in Seo-gu, Gwangju, Seo-gu.
In other words, they stolen them.
[2017 Highest 2072] On April 24, 2017, the Defendant ordered the victim K to have a normal payment of the value of food at the J cafeteria located in G in Mapopopo City around 20:00, as if the Defendant had a normal payment ability to pay the value of food to the victim K.
However, the defendant did not have any intention or ability to pay the price.
Nevertheless, the defendant deceivings the victim as above and obtained food equivalent to 30,000 won in total from the victim.
[2017 Highest 505]
1. On October 25, 2017, the Defendant: (a) had no intent or ability to pay the taxi cost in the vicinity of the west-gun, YY-gun, the U.S. on October 25, 2017; (b) had the victim deceptioned the victim as if he would have been operating in MM taxi and would pay the taxi cost; and (c) has used the said taxi to run in front of the O cafeteria located in the South-Namn N in the South-west coast of the same day until around 22:30 on the same day.
