The prosecution of this case is dismissed.

1. The Defendant in the facts charged of this case is a person driving a passenger car by borrowing B.

A. On June 30, 2017, the Defendant violated the Road Traffic Act (e.g., post-accidents) (e., the Defendant proceeded at a speed of one-lane between the two-lanes at the front of the entrance of marijuana, 51-4, the early beginning of the Gamar-si, Gyeonggi-gu, Hyeong-si, and the front of the road at a speed of one-lanes, which is visible from the front side of the road to the right side of the road at the right angles.

In such cases, a person engaged in driving service has a duty of care to prevent accidents that may occur due to the accurate operation of the steering gear and the steering gear.

In the end, the Defendant destroyed the central separation unit due to the above occupational division, thereby impairing its utility by damaging an estimated property, and immediately stopped and left the site without taking necessary measures, while leaving the site.

B. On June 30, 2017, the Defendant driven the said vehicle without a driver’s license at a section of about 4 km up to the entrance of “li-mariririju” located in the upper right corner of the Gyeonggi-si, Gyeonggi-gu, Gam-si, in front of the Gamri 51-4, on the road in front of the Gamri 51-4, the Defendant violated the Road Traffic Act (unlicensed Driving).

2. According to the records, the Defendant’s death was recognized on August 1, 2017, prior to the institution of public prosecution of this case, and thus, the instant public prosecution is dismissed pursuant to Article 327 subparag. 2 of the Criminal Procedure Act, and it is so decided as per Disposition.
