The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal is proceeding without neglecting the duty to protect pedestrians in the crosswalk.
The victim was shocked to suffer serious injury.
2. The court below stated the reasons in detail, and judged that it is difficult to see that the defendant caused a traffic accident by neglecting his duty of care in the course of performing his duties. In comparison with the reasoning of the judgment below, the judgment of the court below is just and acceptable.
3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
