1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of premise;
A. On November 20, 2013, the Plaintiff was selected as a coastal cruise operator of the Changwon-si, Changwon-si, the purpose of marine tourism and regional economy revitalization, and entered into an agreement with the Defendant on November 20, 2013 (hereinafter “instant agreement”).
The main contents of the instant agreement are as follows.
Article 3 (Duties and Roless) ① The duties and roles of the defendant are as follows:
1. As a result of the performance of the business concerned, allocation of mother-going seats, landing points, passenger terminals, parking lots, broadcasting facilities, and other facilities incidental to the business convenience shall be provided;
2. It shall provide administrative and financial support for marketing advertisements, publicity (press media, etc.) and authorization, permission, etc. to revitalize coastal cruise operation business, attract domestic and foreign tourists;
3.In order to revitalize the coastal cruise industry, mutual assistance systems shall be maintained in close cooperation with the Plaintiff.
(2) The plaintiff's duties and roles are as follows:
1. It shall be responsible for the overall management of business, such as purchase and management of ships, human resources, business management, etc. following the implementation of a coastal cruise program, and shall bear all the expenses incurred therein;
(hereinafter omitted) Article 5 (Expenses Borne by the Defendant) (1) The Defendant’s apportionment of expenses is as follows:
1. Some expenses incurred in administrative support for cooking type;
2. Expenses for the press publicity and marketing activities (execution within budgetary limits);
3. Expenses incurred in maintaining and managing facilities, such as a terminal.
1. Expenses incurred in relation to navigational meals (referred to return courtesys, free of charge, meals, etc.), but the scope of support shall be determined in consultation with the defendant;
2. Expenses for marketing activities to attract customers other than the defendant;
3. Legal expenses incurred in relation to the use of facilities, such as a terminal, including rents and landing fees;
4. Business losses incurred by operation;
5. The Convention under Article 6, including the cost of compensation (including boarding and leaving a ship), etc. when a safety accident of a ship user occurs;
