Reasons
Punishment of the crime
On February 9, 2018, the Defendant was sentenced to a suspended sentence of one year for criminal fraud at the Seoul Central District Court for six months, and the judgment became final and conclusive on the 20th day of the same month.
Around October 2015, the Defendant: (a) made a false statement to arrange a loan of at least 2 billion won necessary for the construction of a new building on land to D, who is the landowner, and (b) made D, a corporation for the purpose of housing construction (new construction and sale), etc.; (c) received and used KRW 50,20 million in total from D for expenses incurred in arranging PF loans from around November 23, 2015 to August 30, 2016; (d) on July 27, 2017, the Defendant was sentenced to a suspended sentence of imprisonment of at least one year for six months at the Seoul Central District Court on June 20, 2018; and (e) paid KRW 100,000,000 to H on February 10, 2018; and (e) the victim F’s representative director was paid KRW 100,000 from July 10, 2017 to July 17, 2019.
The defendant did not actually operate the corporation E, and there was no intention or ability to implement the PF loans for the construction of a new building in the Incheon Southern-gu B or C ground, and there was no intention or ability to repay the money from the victim as a person with bad credit standing who has no particular property.
Nevertheless, around February 6, 2018, the Defendant, in the collection of a knife near Incheon Seo-gu I apartment complex, was running as if the Defendant actually operated a stock company E, and the Defendant, in relation to the construction of a new urban community facility B and C implemented by a stock company E, can only change the representative of the corporation, and continue the business with a PF loan.
If the representative of a corporation is changed to J, the PF loans can be directly received, and if the representative of a corporation is changed, the money shall be paid to the representative of the corporation E (D).
