However, the crime of this case is a case of driving a motor vehicle while under the influence of 0.102% alcohol level, and the case is not less than that of the defendant in light of the degree of the driving of the motor vehicle, and it does not seem that there was an imminent or inevitable circumstance that the defendant should drive the motor vehicle in the influence of alcohol level at the time. The defendant had a record of criminal punishment several times due to driving under the influence of alcohol and driving without a license, and the punishment is only six times due to driving under the influence of alcohol, and the revised Road Traffic Act has strengthened criminal punishment by raising its statutory punishment, and the defendant was sentenced to a suspended sentence due to driving under the influence of alcohol level, and even if he was sentenced to a fine for driving under the suspension of execution, it is difficult to expect the defendant's own improvement due to the suspension of execution or probation, and it is also difficult to expect the defendant's own improvement due to the punishment through probation, such as age, the defendant's environment, family relationship, the circumstances surrounding the crime of this case, etc.
