1. Details of the disposition;

가. 원고는 B직업전문학원(이하, ‘이 사건 훈련기관’이라 한다)을 운영하는 자이고, 이 사건 훈련기관은 2014년∽2015년 직업능력개발훈련과정 통합 및 수시검사에서 “한국기술교육대학교 직업능력심사평가원(이하, ’직업능력심사평가원‘이라 한다)”의 종합적인 심사를 통해 ’디지털디자인‘ 등 46개 훈련과정을 승인받았다.

B. On August 27, 2015 and March 7, 2016, the Plaintiff entered into an entrustment contract for the training for the occupational categories of the national key strategic industry with respect to “product design (CAD, 3D remodeling (hereinafter “instant training courses”) using digital design, 3D printers,” among the training courses approved as above pursuant to Article 16 of the Act on the Development of Workplace Skills of Workers (hereinafter “Vocational Skills Development Act”), and the Plaintiff recruited trainees for each of the instant training courses as follows.

The number of trainees during the training period for the name training course is seven hours (five hours per day) from April 20, 2016 to September 70, 2016, using 19 and 3D printers for the product design using 19 hours (7 hours per day) from April 20, 2016 to September 19, 2016.

C. On June 8, 2016, the Defendant received unfair training reports on the process of “digital design” (hereinafter “the instant information”) from anonymous trainees, and conducted a joint inspection on June 23, 2016 by visiting the instant training institution to conduct surveys against trainees (hereinafter “the instant joint inspection”).

On October 10, 2016, the Defendant, “(i) the digital design process begins, 4 weeks after the commencement of the training, is proceeding with the “stoptop Q Q Q qualification test pool”, and ② the product design process using 3D printers is a modeling process using 40 hours a period of 7 days in the training schedule.
