A defendant shall be punished by imprisonment with prison labor for not more than ten months.

The defendant is an applicant for compensation of KRW 110,000 and the defendant is an applicant for compensation.

"2019 Highest 1340"

1. Around December 15, 2018, the Defendant, without intention or ability to sell goods, such as mobile phones, posted an online website HI a notice on the sales of “Aphone XS A” on the website H, and as if he/she sold Aphone XS mobile phone to the victim J, he/she falsely speaks as if he/she sold Aphone XS mobile phone, and then, he/she received KRW 80,000 from the victim J to the K bank account (Account Number: L) in the name of the Defendant as the sales proceeds of the mobile phone from the victim J to May 17, 2019, and acquired the money in total of 40 times from the victims, such as attached Table 1, a total of KRW 10,896,00,00 from the victims, as shown in attached Table 1, from around 17, 2019.

In light of the evidence duly adopted by this court and the contents and process of the trial of this case, it is consistent with the fact that it is judged that it does not interfere with the exercise of the defendant's right of defense even if it is modified, the prosecutor has modified it without the procedure of modification of the indictment.

2. On May 15, 2019, when the Defendant did not intend or have the capacity to sell goods, he/she posted to the Internet site HI a sale letter stating “galthal lus selling” on the Internet site HI, and falsely speaks as if he/she sold the said goods to the victim M who had contacted with it, and received 105,000 won from the victim M to the N account (Account Number:O) in the name of the Defendant from May 30, 2019, from that time, he/she received KRW 3,872,00 won in total from the victims every 26 times as shown in the attached list 2 and the attached list 3.

3. The Defendant was on May 201, 201, who was on the part of Busan (hereinafter referred to as “the Defendant”).
