A defendant shall be punished by imprisonment for a term of one year and two months.

The defendant shall be liable for 140,000 won or more by fraud to the applicant C.

Punishment of the crime

On May 13, 2017, the Defendant received KRW 210,000 from the victims in the same way 53 times from the victims to December 2017, 2017, the Defendant received KRW 15,160,000 from the Defendant’s account in the name of the Defendant on the same day and received KRW 210,00 from the victims under the name of the Nonghyup Bank (M) on the same day, by means of a false statement to the effect that “Notwithstanding the lack of intent or capacity to sell the goods, the Defendant shall send the goods if he/she remitted the goods to KRW 210,000 from the victims.”

On November 19, 2017, the Defendant, “2018 Highest 343, the Defendant,” made a false statement to the victim O, which became aware of through the Internet site “N” on a closed ground on November 19, 2017, and the fact that the Defendant did not have the intent or ability to sell the goods, that the Defendant would send golf bonds if it remitted KRW 200,000 to the golf bond price.” The Defendant had the victim transfer KRW 200,000 to the National Bank account (R) in Q’s name used by P, thereby having P receive property.

The Defendant, on November 8, 2017, posted a letter to sell “g golf bonds” by accessing the Internet N-site (S) and then sent a golf bond to the victim T who contacted with the Defendant “640,000 won by deposit of KRW 640,00.”

“A false statement” was made.

However, in fact, the defendant thought that he will pay a fine by receiving money from the injured party, and the victim did not have the intention or ability to sell golf bonds.

As such, the Defendant, by deceiving the victim, received 310,000 won from the City Bank account in U under the name of U as the price for goods on the same day from the victim, and received 330,000 won around September of the same month, and added 16 times in total from the above day to January 15, 2018.
