Punishment of the crime

Defendant

A is a person who operates a warehouse for the storage of counterfeit goods located in Ansan-si G and 205. Defendant B and Defendant C are employees working in the above warehouse; Defendant A had the role of securing import and customers of the goods with a forged trademark attached in China; Defendant B had the role of arranging warehouse management and orders of counterfeit goods; Defendant C had the role of packing and sending the goods upon receiving orders from Defendant B.

1. On October 27, 2016, the Defendants conspired to sell a total of 3,142 counterfeit goods bearing a forged trademark, as indicated in the attached Table 1. As indicated in the attached Table 1., the Defendants infringed on trademark rights by holding 3,142 points (a total of 4,370,530,0530,000 won) of counterfeit goods bearing the forged trademark, as indicated in the attached Table 1.

2. From January 24, 2015 to October 24, 2015, the Defendants conspired to sell counterfeit goods by door to the “I” located in Mapo-gu Seoul Metropolitan Government, after receiving KRW 4,245,00 from approximately 53 registered trademarks of “GUCCI” (registration No. 0070352), the trademark right holder’s “GUCCI”, a trademark of “GUCCI” (registration No. 0070352), which is a trademark of “GUCCI” at the time of rocketing, and then selling them, from around that time to around October 24, 2016, each of them infringed upon the trademark right by selling the total amount of KRW 1,104 (the estimated market price of 1.87,710,000 won) of the goods with a forged trademark as indicated in attached Table 2.
