가. 피고인은 2017. 4. 11. 11:41 경 위 E 어린이집 미 소반 교실 내에서 피해 아동이 밥을 먹지 않고 바닥에 드러눕거나 손가락을 입에 넣자 손바닥으로 엉덩이를 2회 때리고, 같은 날 11:45 경 피해 아동이 바닥에 엎드려 있자 엉덩이를 2회 때리고, 같은 날 11:50 경 피해 아동이 밥을 먹지 않고 손가락을 입에 넣자 오른손 손가락으로 피해 아동의 입 부위를 1회 튕겨 피해 아동이 울음을 터뜨리게 하고도 달래 주지 않는 등 아동의 신체에 손상을 주는 신체적 학대 및 정신건강에 해를 끼치는 정서적 학대행위를 하였다.

B.
