A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Special intimidation;

가. 피고인은 양극성 정동장애로 인하여 사물을 변별하거나 의사를 결정할 능력이 미약한 상태에서, 2015. 5. 23. 09:00경 의정부시 시민로 80 소재 의정부역 3번 출구 앞에서, 당일 아침 함께 술을 마시다가 사라진 노숙자 C을 찾는다며 평소 소지하고 다니던 맥가이버 칼을 왼손에 쥔 상태로 주변을 돌아다니던 중 일부 여성 행인들이 자신에게 “미친 놈”이라고 하는 말을 듣게 되자 그곳 의자에 앉아 있던 피해자 D(여, 22세)에게 다가가 “씹할 년아” 등으로 욕설을 하고 위험한 물건인 위 맥가이버 칼(칼날길이 약 7센티미터, 증 제1호)을 피해자의 목에 들이대며 피해자의 생명, 신체 등에 어떠한 위해를 가할 듯한 태도를 보여 피해자를 협박하였다.

B.
