Defendant shall be punished by a fine of KRW 500,000.
However, the execution of the above punishment shall be suspended for a period of one year from the date the above judgment becomes final and conclusive.
Reasons
Punishment of the crime
On March 10, 2020, the Defendant: (a) committed a theft of the victim’s property on the 10t truck by taking advantage of the gap that caused approximately approximately KRW 27t of the amount of trees set up by the victim D to be punished for the expansion of E, in the middle of the 10t truck.

In light of the following circumstances acknowledged by the evidence duly adopted and investigated by this court, namely, the fact that this court stated that the employee of the Suwon branch of the Korea-Road Corporation would bring trees near E in Korea, but the above place is recognized as having no authority to manage and dispose of the Suwon branch of the Korea-Road Corporation (it is not known that the Defendant asked the employee of the Suwon branch of the Korea-Road Corporation to inquire of the said branch office of the Korea-Road Corporation by specifying the above location, status of trees, quantity, etc.). The above place is where trees were stored in the state of trees while carrying out civil works in the area of the extension of the road adjacent to the expressway, while taking into account the following circumstances, such as the fact that the Defendant was punished by the on-site manager while carrying out the trees, and the Defendant did not return the trees.
