A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. The Defendant violated the Act on the Honorable Treatment of and Support for Persons of Distinguished Services to the State, while living together with the Defendant’s father C, who received the patriot benefits from the Ministry of Patriots and Veterans Affairs, died on August 7, 2008. The Defendant was able to conceal the death of the said C and receive the said patriot benefits.
Upon the death of C on or around August 7, 2008, the Defendant reported the death of C to an administrative agency and reported the death to the Minister of Patriots and Veterans Affairs immediately. However, the Defendant was paid KRW 67,852,20,220 in total for 68 months in total, as shown in the attached Table 1, by means of concealing the death of C, by failing to report the death of the said C to the administrative agency and the Minister of Patriots and Veterans Affairs on September 12, 2008, by means of concealing the death, such as failing to report the death of the said C, etc. to the administrative agency and the Minister of Patriots and Veterans Affairs.
Accordingly, the defendant received veterans' benefits by fraud or other improper means.
2. The Defendant: (a) had actually operated the FESLG car under the joint name of C and its respective ASEAN; (b) had been receiving 220 won per liter of LPG fee using the welfare card issued by a person of distinguished service to the State on the ground that C was a person of distinguished service to the State; and (c) had been receiving support of 220 won per liter of LPG fee by using the welfare card issued by the person of distinguished service to the State on the ground that C was a person of distinguished service to the State; (d) even after the death of C, the Defendant
Around June 2, 2009, the Defendant entered “C” in the name column of deposit holders to the effect that the period of validity is to be reissued after arrival of the application for the re-issuance of the Welfare Card for Persons of Distinguished Service to the State, which is located in the Jeonju-si, Jeonju-si, Jeonju-si, and affixed C’s seal prior to possession on the applicant C’s name, i.e., the Ministry of Patriots and Veterans who may know of the forgery.
