Defendant shall be punished by imprisonment for a term of one year and eight months.

Punishment of the crime

On January 12, 2007, the Defendant was sentenced to one year of imprisonment with prison labor at the Gwangju District Court for fraud, etc. and completed the execution of the sentence in the prison on October 25 of the same year. On May 28, 2014, the Defendant appealed on May 28, 2014 at the Gwangju District Court, which was sentenced to one year and two months for fraud, and is still pending in the trial at the same court.

1. Fraud;

A. On May 17, 2009, the Defendant stated to the effect that “The Defendant shall repay the victim Q Q 200,000 won immediately after three days if he/she borrowed the victim Q 200,000 won as he/she requires pay,” at the office of the scrap metal business in which the Defendant had operated the Nam-gu P.

However, at the time, the defendant did not have any intention or ability to repay the above money, even if he borrowed money without any other property or income.

Nevertheless, the Defendant received 200,000 won from the victim to the agricultural bank account in the name of the Defendant on the same day and acquired them by money.

B. The Defendant, at the same place on August 20, 209, stated to the effect that “If 500,000 won are loaned to the victim Q, it is necessary to pay 500,000 won, it shall be paid immediately after 3 days.”

However, at the time, the defendant did not have any intention or ability to repay the above money, even if he borrowed money without any other property or income.

Nevertheless, the Defendant received 500,000 won from the victim to the Agricultural Cooperatives Deposit Account in the name of the Defendant on the same day and acquired it by money.

C. On August 21, 2009, the Defendant told the victim Q to the effect that “the head of the family in Korea is the head of the R prison, and the head of the S prison General Affairs will be transferred to the victim Q at the same place.” On the other hand, the Defendant stated to the effect that “The head of the Gu in Korea is the head of the R prison, and the head of the S prison General Affairs division will immediately be transferred to the S prison.”

However, at the time, the defendant works as the chief of prison.
