A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall impose duties on any salesperson or any person who intends to become a salesperson by taking advantage of any multi-level marketing organization or any similar organization that is comprised of persons by stages, to collect expenses or other money or valuables in excess of the level prescribed by Presidential Decree, regardless of name or form, such as membership, sales aids, sales individually allocated, educational expenses, etc. and shall establish, manage, or operate a multi-level marketing organization without being registered with the Fair Trade Commission, etc. in accordance with procedures prescribed by Presidential Decree.
