A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On February 24, 2006, the Defendant received a summary order of a fine of KRW 3 million from the Incheon District Court to the same crime on May 3, 2016.

[Criminal facts]

1. The Defendant is a person who is engaged in driving a Brane car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused before the risk).

On April 7, 2018, the Defendant driven the above vehicle at around 20:18, and proceeded with the central line while driving the street room in front of the "D" store in Nam-gu Incheon Metropolitan City, Incheon, along with a single-lane from the apartment on the side of the water-passing village to the water market under the circumstance that it is difficult to normally drive the street in front of the "D" store in his blood.

At all times, a person engaged in driving on a road that has a center line of yellow solid lines has a duty of care to thoroughly conduct the front-way and to safely continue driving on the street.

In doing so, due to the negligence of the franchising the central line of alcohol, the victim E (39) who is proceeding one lane of the opposite franchising car in the middle line of the Franchising car, suffered from the injury, such as franchising franchising to the left side of the franchising car, and the above E and his franchis G (n, 36 years old) requiring approximately two-day medical treatment.

2. Around April 7, 2018, the Defendant violated the Road Traffic Act (drinking) driving a B-low-income vehicle with approximately KRW 50 meters alcohol content 0.161 percent from the golf course in front of the front of the “D” store located in Nam-gu, Incheon Metropolitan City, to the front road of the “D” store.

3. On April 7, 2018, the Defendant interfered with the performance of official duties: (a) was sent to K with the circumstances belonging to the Jungdong Police Station of Incheon Southern-dong, Incheon, who was dispatched to the site after receiving a report from 112 that drinking traffic accidents occurred in front of I located in H in the Namdong-gu Incheon Metropolitan City, Nam-gu.
