Reasons
Facts of recognition
A. The Plaintiff is a person running the “C” (hereinafter “instant auction place”) in the Daejeon Pungdong-gu, Daejeon, and the Defendant is a person running the retail business of pet goods with the trade name “D” in the Namdong-gu, Incheon.
B. The E Co., Ltd. (hereinafter “E”) broadcasted the broadcast of the title “H” (hereinafter “instant broadcast”) in the TV program “G” (hereinafter “instant program”) “G” on the F date.
The gist of the instant broadcast is that “the propagation which produces grasium is being operated closely, and an auction is conducted nationwide to sell a large number of grasiums,” and in relation to the part concerning the auction of grasium, the operation of the instant auction house appeared on the broadcast screen.
C. At around April 21, 2016, I produced the instant broadcast, entered the instant auction house and used it on the screen of the instant broadcast without the Plaintiff’s consent.
