피고인은 경북북부제1교도소에 수감 중이던 사람으로, 2014. 9. 12. 06:50경 위 교도소 2상 C에서 동료 수감자인 피해자 D(47세)에게서 “야 밥상 차려놨는데, 팬티라도 입고 나와라.”라는 말을 듣자 서로 욕설을 하던 중 화가 나 주먹으로 피해자의 얼굴을 수회 때려 피해자에게 치료기일 불상의 눈부위 타박상 등을 가하였다.
