1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Determination as to the cause of claim
A. Fact 1) The Plaintiff is a housing reconstruction and improvement project partnership under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents established around May 26, 2010 in order to promote the housing reconstruction improvement project (hereinafter “instant project”). Defendant B completed the registration of establishment of a collateral security (the maximum debt amount of KRW 7,50,000, the debtor, and the mortgagee B, as the Seoul Central District Court No. 87811, July 25, 1987, with respect to the share of KRW 14,464,00,00, which is the land for the instant project, as the maximum debt amount of KRW 7,50,00,000, the debtor, and the mortgagee B, the mortgagee, and the Defendant Korea Trade Co., Ltd. (hereinafter “Korea Trade”) completed the registration of establishment of a collateral security (the maximum debt amount of KRW 2,435,100,00,000) with respect to the share of G ownership of the land for the instant project.
On the other hand, H and I completed the registration of creation of a mortgage for the respective K ownership share of 22,50,000 won with respect to the land of this case, Gangnam-gu, Seoul, JJ 952.7m2 and F 2,435m2,435m2, which is the land of this case, as Seoul Central District Court No. 16300 on December 2, 1985, the Seoul Central District Court registered the maximum debt amount of 22,50,000 won, the debtor, K, the mortgagee of the collective security, H and I. On September 1, 1990, the defendant C died on or around September 1, 199, and the heir C is one of the deceased children of
(B) On June 23, 2016, the establishment registration of the above neighboring mortgage by the Defendants was completed on the land of the instant business, and the new apartment was published on January 13, 2017.
Pursuant to the aforementioned transfer announcement, the instant mortgage right of Defendant B was newly registered on the ground of the contract to establish a mortgage on July 24, 1987 and the notification of transfer due to an urban and residential environment improvement project on January 13, 2017 with respect to apartment units listed in attached Table 1, which are owned by L on March 2, 2017, and the instant mortgage right of Defendant Korea Trade entered in attached Table 2, which was owned by M on March 2, 2017.
