1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

On March 30, 2011, the Plaintiff, who is a national of the Islamic Republic of Pakistan (Iskistan, hereinafter “Skistan”), was able to enter the Republic of Korea on March 30, 201 and stay as the above sojourn status until January 29, 2016, following the extension of the number of times.

On January 27, 2016, the Plaintiff filed an application for refugee status on the ground that the Plaintiff was threatened with the support of the PPP (PP) Party, a party to the PP (Pkistan Peoples Part) that is a party to the PP (PP) of Suskistan and Pakistan, and that it was threatened with the support of the PMN (Pakistist Musist Musz) Party, a party to the PMN (Pawz). However, on February 26, 2016, the Defendant rejected the recognition on the ground that there was no sufficiently well-founded fear that the Plaintiff would suffer persecution (hereinafter “instant disposition”).

[Grounds for recognition] The Plaintiff’s assertion as to the legitimacy of the instant disposition and the overall purport of the argument as to the facts without dispute, Gap’s evidence Nos. 1, Eul’s evidence Nos. 1, and Eul’s evidence Nos. 1 and 2, and the purport of the entire argument is the support of the PPP party, a party of Pakistan as a party of Pakistan. On July 16, 2015, the Plaintiff took a dispute with the support of the PPN party, a Simph, and thereafter was threatened several times from the support parties of the PLN party from July 16, 2015.

If the plaintiff returned to Korea with Pakistan, he/she applied for refugee recognition because he/she can be killed for the above MFN party.

The disposition of this case, which did not recognize the plaintiff as a refugee, is unlawful, since the plaintiff has a well-founded fear of persecution due to politics and religion, and is recognized as a refugee.

It is as stated in the relevant statutes.

Judgment

'Refugee' is entitled to the protection of nationality countries due to well-founded fear to recognize that he/she is detrimental to race, religion, nationality, status as a member of a particular social group, or political opinion.
