A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 상해 피고인은 2019. 8. 28 12:00 경 전 남 해남군 B에 있는 C 사무실 앞 주차장에 주차되어 있던 피고인 운행의 BMW 승용차 안에서, 배우자였던 피해자 D( 여, 40세) 이 바람을 피웠다는 이유로 손바닥으로 피해자의 입 부분을 1회 때리고, 계속하여 피고인의 딸에게 피해자가 바람을 피운 사실을 알리기 위하여 피고인의 딸이 재학 중인 E 고등학교로 가 던 중 주먹과 손으로 피해자의 얼굴 부분을 수회 때리고, E 고등학교에 도착하자 다시 손으로 피해자의 얼굴 부분을 수회 때린 후 승용차에서 내려 조수석 문을 열고 발로 조수석에 앉아 있던 피해자의 배 부분 등을 수회 차고, 같은 날 12:30 경 피해자와 함께 위 C 사무실로 돌아와 그곳 사무실에서 손으로 피해자의 얼굴을 때리고, 같은 날 13:00 경 피해자와 함께 전 남 해남군 F에 있는 피고인의 주거지로 장소를 옮긴 후 그 때부터 19:00 경까지 사이에 손과 주먹으로 피해자의 몸 부분 등을 수회 때리고 그곳에 있던 골프채로 피해자의 등과 허벅지 부분을 수회 때렸으며, 같은 날 20:00 경 위 주거지에서 손과 발로 피해자의 얼굴 부분 등을 수회 때리거나 찼다.
