Reasons
Punishment of the crime
The defendant is a person who actually operates C Co., Ltd., the export company of man-help mother in Leecheon-si, Gyeonggi-do.
1. The Defendant, in violation of the Act on Special Cases Concerning the Refund of Customs Duties, etc. Levied on Raw Materials for Export (illegal Refund) declared by the competent authorities, to use a simple fixed amount refund system that provides the amount of customs duties to the goods produced by small and medium enterprises in accordance with the simplified fixed amount refund rate table as determined by the Commissioner of the Korea Customs Service, in trust in the application filed by an applicant for the refund, upon the presentation of the export declaration certificate, and in order to unlawfully refund customs duties by filing a false export declaration on a large amount of export than the actual export
The Defendant: (a) around April 23, 2010, the export declaration number D was around 20 times from April 23, 2010 to November 21, 2011; (b) the Defendant filed an application for the refund of customs duties with the customs collector as if he/she exported 50,641,678 won in total; and (c) was paid KRW 277,880 on April 30, 2010; and (d) was paid 20 times in total from April 23, 2010 to November 21, 201, as indicated in the attached Table “The List of Illegal Refund Crimes”; and (e) was paid a total of KRW 581,295,211 won in total from the export amount to KRW 654,586,144 in export declaration; and (e) was paid a refund from around April 21, 2010 to the date of export declaration.
2. On April 23, 2010, the Defendant: (a) filed a report with the competent authority as if he/she exported 50,641,678 K and actually exported the amount of KRW 101,432,730 from the export declaration number D to the export declaration number D; and (b) filed a report with the competent authority as if he/she exported the amount of KRW 101,432,730 to the amount of KRW 50,641,67; and (c) filed a false export declaration list from April 23, 2010 to November 21, 201; and (d) filed a total of 58 items totaled of KRW 3,761,591,407 and exported the total of KRW 6,30,306,27,207.
