The defendant's appeal is dismissed.

The summary of the grounds for appeal (misunderstanding of facts) lies in the fact that the Defendant’s grandchildren contact the victim’s her tam, but this did not have the intention to commit an indecent act as a physical contact with the victim’s tam at the front of the stage where people concentrated.

Judgment

The defendant asserted the same argument as the grounds for appeal in this case, and the court below rejected the above argument in its reasoning. In light of the above judgment of the court below after comparing it with the records, the judgment of the court below is just, and contrary to the defendant's assertion, the court below did not err by misapprehending the facts,

Defendant’s assertion is not accepted.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
