1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. On November 18, 2002, Nonparty L and M jointly purchased shares of 1,322.5/4,419 shares from N on the same day on the same day.
Of the above land, the 1,774/4,419 shares, N in the said land, was divided into O 1,774 square meters on the ground of co-owned property partition on January 22, 2003, and the said Nonparty shared 2,645 square meters prior to J of Gyeonggi-gun, Gyeonggi-do (hereinafter “instant land”); and hereinafter as to the land referred to below, the said land was owned by the said 1,774/419 square meters prior to the said parcel number, unless there is any special reference.
On September 17, 2014, Nonparty M completed the registration of ownership transfer on the ground of sale on September 16, 2014 to the Plaintiff, among 165/2645 shares in the instant land and its own shares in K land 168/11806 shares in 1518/11806.
Nonparty Q, adjacent to the instant land, set up a reinforced concrete retaining wall (hereinafter “the instant retaining wall”) with a thickness of 30 centimeters, length, 70 meters underground, 1.5 meters above ground level, and 4 meters above ground level (hereinafter “the instant retaining wall”), and provided the said site as a private road within an electric power resource complex after the partition, which, around 194, constituted a serious sloped area adjacent to the instant land, around 5,903 square meters prior to the partition of the ownership. After the partition, Nonparty Q, in sequence, connected each point of K, S, e.g., drawings on the instant land, e., d., d., c., c., c., c., and b., each point of which was connected to the instant land, and after the partition, provided the land as a private road within the electric power resource.
The land in this case is now in a state of miscellaneous and miscellaneous land. The north side of the land in this case is surrounded by forests and fields. The part adjacent to S land and K land is surrounded by the retaining wall in this case. The remainder of the south side is adjacent to T land, and there is no retaining wall between them. The part leading to T land in this case is somewhat somewhat somewhat.
