Reasons
Punishment of the crime
1. The Defendant and B advertised the person wishing to purchase at the low-priced vehicle price in the Internet used vehicle sales site, leading the person who did not actually hold at the Internet used vehicle sales site to use it as a used vehicle sales complex, deceiving the person to sell it as if it were sold at the low-priced vehicle price, and conspired to inform him of the fact that the actual sales price is higher and the actual sales price is sold.
B On August 13, 2016, using the temporary name called "C" on the sales website of a mutually influorous Internet used vehicle in 2014, and, after reporting it to the victim D, "it is possible to sell it to 16 million won", the Defendant and B may sell the franchise at a low price in lieu of K7 vehicles on the first floor of the Seo-gu Incheon Building on August 15, 2016.
At the same time, Franchising made a false statement on Franchising vehicles “as sold in an auction car, KRW 17 million, a group of down payment of KRW 2 million is issued,” and “as a result, delivery of down payment of KRW 2 million is made.”
However, the actual value of the above vehicle was KRW 26.7 million, so even if the Defendants received the down payment from the injured party, they did not have the intention or ability to sell the above vehicle at KRW 17 million.
Nevertheless, the Defendant and B, as mentioned above, were accused of the victim and were issued KRW 2 million on the same day from the victim.
2. Any person who intends to conduct a motor vehicle management business in violation of the Motor Vehicle Management Act shall register with the head of a Si/Gun/Gu, as prescribed by Ordinance of Ministry of Land
Nevertheless, the Defendant and B, without registering as a motor vehicle dealer, engaged in the motor vehicle trade without registering as the date and time set forth in the above 1. Paragraph (1) and at the same place as described in the above 1. Paragraph (1) and received the down payment of KRW 2,00,000.
