A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The defendant is in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury).

On June 23, 2019, the Defendant was driving the front road at the time of the 11:30th day, and changed the course from the two-lane to the one-lane while driving the said vehicle.

In such cases, there was a duty of care to prevent accidents in advance by changing the course in a safe way to a person engaged in driving of a motor vehicle.

Nevertheless, due to the negligence of being negligent in driving while under the influence of alcohol, the Defendant suffered from the injury of the victim E (the 61 year old), the victim F (the 45 year old), the victim G (the 59 year old), and the Hastst and other vehicles driven by the Defendant’s Hast and other vehicles with the front panion of the Hast and other vehicles driven by the Defendant. The Defendant suffered from the injury of the victim E, the victim F, and the victim G, each of which suffered from approximately two weeks of injury, such as f, f, and tension, in which there is no two internal measures where treatment is required for approximately two weeks of medical treatment.

2. 도로교통법위반(음주측정거부) 피고인은 제1항과 같은 일시, 장소에서, 사고신고를 접수하고 현장에 출동한 화성서부경찰서 I과 소속 경장 J로부터, 피고인에게서 술 냄새가 나며 얼굴에 홍조를 띠고 말을 횡설수설하는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 2019. 6. 23. 23:48경부터 2019. 6. 24. 12:07경까지 사이에 약 3회에 걸쳐 음주측정을 요구받았으나, 음주측정기의 불대를 제대로 물지 않고 입김을 불어넣는 시늉만 하는 방법으로 이를 거부하여, 정당한 사유 없이 경찰공무원의 음주측정 요구에 응하지 아니하였다.
