A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On February 9, 2019, the Defendant: (a) entered into a gender relationship with the victim C (one-six years of age, and one-six) who met through SNS hosting in the Defendant’s residence located in Daegu-gu Office B; and (b) subsequently, the Defendant was in a sexual relationship with the victim C (one-six years of age).

4. From around 21. to around 28.2, the victim was asked to communicate with the victim several times by telephone and Kakakaoooo, etc., but refused to communicate, and accordingly, the victim’s bridge photographs were spreaded to the surrounding people.

피고인은 2019. 4. 28. 15:42경 불상의 장소에서, 피해자에게 전화를 걸어 피해자에게 “우리 집에서 다 벗고 잤잖아, 놀러 안 올 거야, 그때 벗고 잔거, 나한테 사진 있는데, 진짜, 이 사진 어떻게 해도 돼, 진짜 사진 있다니까, 안 오면 어떻게 할 줄 알고, 니가 오냐 안 오냐에 따라 다르지, 지금 끊으면 그거 어떻게 할지 모른다, 나 지금 말 안하면 어떻게 할지 몰라, 퍼뜨려도 돼, 안 오면 그 입시학원이랑 다 뿌려도 돼, 학교에, 너한테 연락 안하고 그거 어떻게 뿌리든지 할게, 자꾸 그런 식으로 말하면 나 끊는다, 그대로 퍼뜨릴 거라고, 그럼 어떻게 되는지 알잖아”라고 말하여 마치 피해자의 나체 사진을 피해자의 주변 사람들에게 퍼뜨릴 듯이 피해자를 협박하였다.

2. On June 8, 2017, the Defendant violated the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Observance of Secrecy, etc.) was sentenced to a suspended sentence of one year in imprisonment with prison labor for a violation of the Act on the Protection of Children and Juveniles against Sexual Abuse and became subject to registration of personal information after the judgment became final and conclusive on the 16th of the same month.

Where the personal information submitted is changed, the accused shall submit the reason and details of the change to the chief of a police agency having jurisdiction over his/her domicile within 20 days from the date the reason

Nevertheless, around August 2018, the Defendant was in Daegu-gu from Gyeongbuk-gun, the actual place of residence.
