A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On May 17, 2012, the Defendant was sentenced to a fine of KRW 3 million for a violation of the Road Traffic Act at the Seoul Southern District Court on May 17, 2012, and on May 30, 2014, the Defendant was sentenced to a fine of KRW 5 million for a violation of the Road Traffic Act.

1. The Defendant in violation of the Road Traffic Act is a person who is engaged in driving a C-Sti-type car.

피고인은 2014. 11. 18. 03:00경 고양시 일산동구 정발산동 소재 ‘현대아이스페이스’ 앞 편도 2차로 중 1차로를 정발산동 방면에서 라페스타 방면으로 진행하던 중 전방을 제대로 살피지 않은 과실로 마침 피고인이 진행하던 방향 전방에서 신호대기를 위하여 정차 중이던 피해자 D 운전의 E 짚랭글러 승용차 뒷부분을 피고인 운전 차량 앞부분으로 충격하여 피해차량에 수리비 약 3,651,637원이 들도록 이를 손괴하였다.

2. On November 18, 2014, at around 03:00, the Defendant driven a C Sti-type car under the influence of alcohol of about 0.101% of blood alcohol concentration at around 500 meters, without the driver’s license, from the front day of the “acquisition or transfer” road located in the Sonsan-dong U.S. P., Mangyeong-gu, Goyang-si to the front day of Hyundai Spain located in the same location.

3. No person who violates the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle on a road which is not covered by mandatory insurance;

Nevertheless, at around 03:00 on November 28, 2014, the Defendant operated the said vehicle without purchasing mandatory insurance from around 500 meters to the front road located in the Yongsan-gu Seoul Special Metropolitan City, Seoyang-si (U.S.) to the front road of Hyundai Spain located in the same Dong-dong (hereinafter referred to as “acquisition”), and without purchasing mandatory insurance, from around December 5, 2013 to November 18, 2014.
