A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a business owner who operates the “D” of a waste disposal company located in the petition-gu C at the Cheongju-si.
1. On January 19, 2017, the Defendant involved in the death of an employee: (a) took overall control of safety work at the above site; (b) at the time employees E engaged in the work of inserting the waste vinyl and waste plastics in the pressure air at the above workplace; (c) in such a case, the Defendant, the owner of the business, installed a machine engine string, electric string, fishing, swimming, blick, slick, slick, etc. on the part where the employee might face danger; and (d) installed a cover, a structure, or a stud, a slick, etc. on the part where the employee is in charge of a machine sleeped with the driver’s hand, and installed a lock that does not pose danger to the employee’s hand; and (d) installed a device that does not pose danger to the employee’s accident and safety measures, such as operation of the body, etc. immediately when he/she is in need of the duty to take safety measures, such as operation of the body, etc.
Nevertheless, the Defendant neglected the duty of care as above and did not perform safety measures at the same time, and caused the death of the injured party, such as pressure, etc., on the same day, by letting the damaged party wear the waste vinyl and waste plastics in the pressure outlet at the pressure outlet with a pipe.
2. Implementation of other safety measures.
A. The business owner must reinforce the structure with sufficient strength to take protective measures, such as safety railing, fences, vertical fall telescopes, or covers, at a place where workers are likely to fall, as the end or opening of the work plate and passage, even though the business owner is required to install a strong strength.
