A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 재물 손괴, 업무 방해 피고인은 2017. 1. 15. 12:50 경 동해시 C에 있는 피해자 D가 운영하는 E 모텔 310 호실에 투숙하던 중, 그 다음 날인 2017. 1. 16. 07:40 경 E 모텔 1 층 안내실로 내려와 피해자에게 러시아 어로 ‘ 찹찹' 이라고 말하며 손으로 음식을 먹는 제스처를 취하였으나 피해 자가 피고인의 말을 이해하지 못한다는 이유로, 갑자기 그 곳 안내실 옆 바닥에 비치되어 있던 소형 분말소화기를 집어들고 열려 있던 안내실 창문 안쪽을 향하여 분말소화기를 분사하여 그 분말이 안내실 내부에 있던 피해자 소유인 카드 체 크기, 컴퓨터, 스피커 폰, 가스렌지, 전기밥솥 등 합계 3,201,000원 상당의 물품에 뿌려 지게 한 다음, 위 안내실 앞을 오가며 큰 소리를 지르는 등 소란을 피웠다.

Accordingly, the defendant has harmed the utility of property owned by the victim, and has interfered with the victim's business by force.

2. On January 16, 2017, at around 10:20, the Defendant damaged public goods: (a) was arrested by a police officer who was on the street before Eel and was dispatched to the site, and was transferred to the office of the police station information security and external investigation team in Gangwon Sea, which was located in F at the time of the East Sea; (b) on the ground that, around 13:10 on the same day, the Defendant was unable to smoke at the above office at around 13:20 on the upper end of the steering (80cm in width, 19.5cm in length, 19.5cm in length) installed on the back of the office’s back on the back of the head, and continued to receive at one time a part of the steering (79cm in width, 13cm in length, 13cm in length, 200 won in total) installed on another book by the Defendant.

Accordingly, the Defendant damaged the goods used by public offices.
