No one shall publish or report by citing the details and result of a public opinion poll that may result in a presumption on the elected person in the election within 6 days before the election day to the close thereof on the election day

1. 피고인 A 피고인은 2014. 6. 3. 15:41경 J에 있는 K에서 피고인의 스마트폰(L)을 이용하여 위 I의 선거사무장인 C으로부터 전송받은 “제목: 전달: 전달: 전달해주세요, I23.8, M27.6, N13.2. 보수 교육감 후보가 진보 후보에게 밀리고 있습니다. I 후보에게 표를 집결시킵시다.”라는 내용의 카카오톡 메시지(이하 ‘이 사건 카카오톡 메시지’라고 한다)를 O에게 전송하고, 같은 날 15:46경 P 등 7명이 있는 카카오톡 대화방에 전송하였다.

2. 피고인 B 피고인은 2014. 6. 3. 16:00경 피고인의 스마트폰(Q)을 이용하여 위 I의 선거사무장인 C으로부터 전송받은 “제목: 전달:전달해주세요, I23.8, M27.6, N13.2. 보수 교육감 후보가 진보 후보에게 밀리고 있습니다. I 후보에게 표를 집결시킵시다.”라는 내용의 카카오톡 메시지를 R 등 9명이 있는 카카오톡 대화방에 전송하였다.
