A defendant shall be punished by imprisonment for 13 years.
The one unit (No. 1) of the seized Samsung Tallon phone shall be confiscated.
Reasons
Criminal facts
The facts constituting the cause of the attachment order [criminal facts] Defendant and the person to whom the attachment order was requested (hereinafter referred to as “Defendant”) are the parents of the victim C.
1. On April 30, 2012, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Rape with Minors under the age of 13) and the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Rape with Relatives in relatives) committed rape with a relative and under the age of 13 over four times, as described in attached Table Nos. 1 through 4, on April 30, 2012, following the Defendant’s residence inside the Defendant’s residence located in Dong-si, including the victim (the age of 12 at that time) who was under his/her own arms, left off the victim’s chest with his/her clothes.
2. The Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent act by force in relation to relatives), around the beginning of February 2012, 201: (a) laid off the victim (in a female and 13 years of age) from the inside of the residence of the said accused on the part of the said accused’s living room; (b) laid off the victim’s breast part of the victim’s chest and forced the victim to commit indecent act by force; and (c) committed indecent act by force on two occasions during the period from around that time to March 9, 2013, as set forth in [Attachment Table] 5 and 7.
3. The Defendant violated the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Rape within Relatives in relation to relatives) in wintering from the place of residence of the above Defendant on March 2012, 201 to the victim (the age of 13) who was in line with his/her clothes, forced to go off his/her body, tried to put his/her sexual organ into the part of the victim, but did not easily enter the victim’s sexual organ into the part of the victim, and sexual intercourses with the victim at the same time during the period of the Defendant’s sexual organ during which he/she was sexual intercourse, as described in the attached Table Nos. 6, (8), (9), and (10), and four times as between March 25, 2013.
