A A shall be punished by a fine of KRW 3 million, by a fine of KRW 2 million, and Defendant B shall be punished by a fine of KRW 700,000.
Reasons
Punishment of the crime
1. The Defendants’ joint criminal conduct (Attempted Fraud) shared by the Defendants: telephone counselor, Defendant A, and Defendant B shared each role with the dispatch staff; by inducing the victims to sell a single-use motor vehicle advertisementd on the Internet used vehicle sales site; making a sales contract by inducing the victims to sell a motor vehicle similar to the advertisement at a price lower than the market price; and by making the victims waive the purchase on their own on the ground that there is an additional price and a serious defect not mentioned at the time of the contract, and subsequently, soliciting the Defendants to sell a motor vehicle at another high-priced level without setting up the victims, such as concluding the contract.
On January 30, 2019, according to the above public offering, Defendant C searched D instrumenting cars (sale price of KRW 2 million, 2018, 2018) advertised on the Internet used cars (sale price of KRW 2 million, 2018) and introduces himself as E in response to the victim’s telephone call who wishes to purchase the said new-learning cars, and as soon as possible, he introduced him as E by means of court auction. Such a vehicle can immediately go, and this would be 1.5 million won at the time of purchase. It means that the victim’s cell phone will be 1.5 million won at the time of purchase.” Accordingly, the victim’s cell phone sent a text message, “I am about the above vehicle’s photograph, etc.” and entices the victim to KTX name.
Defendant
A and Defendant B received information from Defendant C to the victim on January 31, 2019, and received from Defendant C, around 09:00, the sales price was 6,000,000 won, showing the 2018 smoke-based G-based G-learning cars similar to the advertising at the 5th floor of Seo-gu Incheon, Seo-gu, Incheon, in light of the same day at around 09:30.0.
However, in fact, G Ga new bargaining motor vehicles are motor vehicles not owned by the Defendants, and the market price is 8 million won.
