[Defendant A] The defendant shall be punished by a fine of KRW 700,000.

If the defendant does not pay the above fine, 100,000.

Punishment of the crime

1. Around February 17, 2018, Defendant A’s sole criminal conduct (Embezzlement of possession) acquired one copy of the DNA card owned by the victim C, which was lost by the victim C, in the vicinity of the Bupyeong-do Busan Northern Station located in Seocheon-do.

The Defendant, without going through necessary procedures such as returning the credit card acquired as above, embezzled the credit card as he had.

2. The Defendants conspired to use the credit cards acquired by Defendant A together, as stated in the above paragraph (1). A.

At around 04:42 on February 17, 2018, Defendants in violation of the thief and Specialized Credit Financial Business Act purchased goods equivalent to 600 won from the vending machine managed by the victim’s name in Mapo-gu Seoul Mapo-gu, with C’s credit card acquired as described in paragraph (1), and used the lost credit card.

B. On February 17, 2018, the Defendants in violation of the Fraud and Specialized Credit Financial Business Act purchased a miscellaneous worth of KRW 39,220 won from G sales stores operated by the victim in the name-free statement in the name-free statement in the Nowon-si, Nowon-gu, Seoul Special Metropolitan City on February 17, 2018, and used credit cards lost by being delivered goods worth KRW 328,690 through nine times in total, including using the lost credit cards after presenting it to the above employees as if they had legitimate right to use them, as described in paragraph 1.

C. On February 17, 2018, the Defendants attempted to pay 12,020 won for goods by presenting C’s credit card acquired as stated in paragraph (1) to the employees of the said store as if they had legitimate right to use the goods, but failed to pay by the credit card return.
