A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

The Defendant is a person who was in a de facto marital relationship with C from July 2012 to May 2013.

1. Around January 2013, the Defendant made a false statement to the victim stating, “The Defendant would lend Nikon Carren Lene to another person and receive rental fees.”

However, the facts are that the defendant only lent the above carmeras to the pawnban and did not intend to lend it to another person and receive the rent.

The Defendant was issued from the victim the Nikon MRⅡ in an amount equivalent to the market value of 3.5 million won. The Defendant was issued the Victim with the Model Name AF-S 70-20/20/8G EDRV.

Accordingly, the defendant was given property by deceiving the victim.

2. Around January 2013, the Defendant: (a) lent to the victim a car owned by the victim to another person; and (b) received a loan fee; and (c) kept the said car for the victim after being delivered the said car from the victim; (d) borrowed KRW 7 million from the loan office of a lending company with no trade name known in Gyeyang-gu Incheon Gyeyang-dong around February 2013, the Defendant left the said loan amounting to KRW 31 million at the market price as security.

Accordingly, the defendant embezzled the victim's property.

3.
