Reasons
1. Basic facts
A. The Defendant is a management body composed of sectional owners for the management of the building indicated in the separate sheet (hereinafter “instant building”) pursuant to the Act on Ownership and Management of Condominium Buildings (hereinafter “the Aggregate Buildings Act”), and the Plaintiff is a sectional owner of the instant building C.
B The promotion committee for the management of the instant building E divided ownership, which consists of the committee for the management of the instant building, has the honor to give notice of the public announcement of the holding of the temporary assembly (the sectional ownership general meeting).
Article 33(4) of the Aggregate Buildings Act provides that the instant building [5.66% of the total sectional owners shall consent to convening an extraordinary meeting of the management body (5.66%)] shall meet the requirements for convening an extraordinary meeting of the management body, so it is rarely known that the extraordinary meeting of the management body of the instant building (hereinafter referred to as the "general meeting") should be convened and held as follows.
